CONFLICTOS EN LAS INDEPENDENCIAS HISPANOAMERICANAS: LAS EXCOMUNIONES DE LOS INSURGENTES DE LA PAZ Y SU VALIDEZ CANÓNICA R ESUMEN Como consecuencia de la insurrección de La Paz el 16 de julio de 1809, el obispo de dicha sede, Remigio de la Santa y Ortega, levantó excomunión latae sententiae contra los insurgentes de dicho alzamiento. El presente artículo analiza la validez de dichas excomuniones, a partir de los datos ofrecidos por las fuentes documentales de la época, tanto desde el lado de los realistas como de los inde- pendentistas. Precisamente por ello una de las aportaciones más significativas del presente artículo es la documentación al respecto. La conclusión, después de ana- lizar la complejidad que tiene el derecho canónico, con anterioridad al CIC de 1917 es que la primera excomunión del titular de la sede de La Paz fue lícita y válida, lo que no sucedería con las siguientes. Pero, al mismo tiempo, teniendo en cuenta la condición peculiar de las normas canónicas dichas excomuniones han de ser consideradas como históricas y, por lo mismo, sin ningún valor en el momento presente. A BSTRACT As a consequence of the uprising in La Paz –July 16, 1809– the local bish- op, Remigio de la Santa y Ortega, revoked the excommunication latae sententiae raised against the insurgents in the uprising. This article examines the validity of these excommunications, from the data provided by the documentary sources of that time, both from the side of the royalists as well as from the side of those in favor of the independence. Precisely because of this, one of the most significant contributions of this paper is the documentation about this matter. The conclu- sion, after analyzing the complexity of the canon law prior to the CIC of 1917, is that the first excommunication of the holder of the see of La Paz was lawful and valid, which did not happen with the following ones. But at the same time, tak- ing into consideration the peculiar condition of the canonical norms such excom- munications should be considered as historical and therefore, with no actual value.
